Co-Counsel and Referral Management for Law Firms: Track Referrals, Share Cases, and Protect Fees

Referrals from criminal defense lawyers, family law practitioners, estate planning attorneys, and even other PI firms handling conflicts or case-type mismatches are a high-quality, low-cost source of cases.   • Fee obligations: What percentage is owed to the referring attorney? When is it due? Has it been paid?
  • Relationship maintenance: When did you last update the referral partner on their referred case? Are you keeping them informed as you would a referring physician who sent you a patient?

Firms that track these metrics systematically build stronger referral networks. Firms that don't eventually lose referral partners who feel ignored or undervalued.

Maintain a directory of referral partners with contact information, referral history, and notes on the relationship. When a case comes in that doesn't fit your practice, you should be able to quickly identify the right firm to refer it to — strengthening the reciprocal relationship.

Compliance considerations for fee sharing

ABA Model Rule 1.5(e) governs the division of fees between lawyers who are not in the same firm. Generally, the division must be proportional to services rendered (or each lawyer assumes joint responsibility), the client must agree in writing, and the total fee must be reasonable.
